There is a substantial amount of risk for lenders in the secured transactions process, both when filing UCC records and when conducting due diligence searches.

Even what common sense might call a minor error can make the difference between a lender collecting the entire obligation if the debtor defaults and, perhaps, being left with nothing but legal expenses.

This workshop equips those who file or search UCC records with the essential skills necessary both to master the process and to avoid the numerous yet subtle traps awaiting the unwary.

The first day of the workshop goes line-by-line through the UCC-1 financing statement and explains the proper techniques used to compile and provide each piece of required information necessary to perfect the lender’s security interest.  The analysis of each element will identify the best practices and what common, but risky shortcuts, to avoid.

The second day of the workshop deals with the other side of the filing coin, UCC searches.  The workshop will explain the essential elements necessary to generate a reliable UCC search, the hidden meanings of records when interpreting the disclosed results, and how best to avoid the broad risk borne by those who will rely on UCC search results.

Upon completion of the workshop, attendees will be able to file UCC records and conduct searches with confidence that they possess the essential skills for effectively managing the risks involved.

What Attendees Will Learn:

  • The process for providing correct debtor names.
  • How to determine the location for filing and searching.
  • Collateral description requirements.
  • When to file UCC records electronically.
  • How to manage the risks UCC Article 9 imposes on searchers.
  • How to create a sufficiently diligent search strategy.
  • Tips for correct interpretation of UCC search results.

This program will be a virtual program.
