Courtesy of the financial crisis and ensuing recession of 2008 and 2009, there have been a number of bankruptcies during the past several years that have had Bankruptcy Courts looking at intercreditor agreements. No question, the predominant trend is that the Bankruptcy Courts will review and enforce the terms of intercreditor agreements, even though the agreement is between two “non-debtor” parties (that is parties that are not subject to Chapter 11). Revised Debtor-Naming Rules Under 2010 Revisions to Article 9

The 2010 Amendments to the Uniform Commercial Code, which became effective in most U.S. jurisdictions during 2013, clarified the rules regarding debtor-naming (and related information requirements) for financing statements in situations involving collateral being administered by a personal representative of a decedent’s estate or held in a trust. This article discusses those changes and summarizes the revised debtor-naming and informational requirements for such financing statements. Read more
